Campground Booking System Terms and Conditions

 

Parties to Agreement

The parties to this agreement are the Conservation and Land Management Executive Body established under section 36 of the Conservation and Land Management Act 1984 (CALM Act) (representing the Department of Environment and Conservation) and you.

 

1. Commencement

This agreement commences when you select the icon to confirm that you agree to the terms and conditions of this agreement.

 

2. Variation

These terms and conditions or any feature on or accessible through the System may be changed or discontinued at any time and any such changes will be set out on the System.

 

3. Camping and Other Fees

3.1 You agree to pay in accordance with this agreement the camping and other fees and charges which you would upon camping at your selected camp site otherwise be liable to pay under the Conservation and Land Management Regulations 2002 (CALM Regulations) as amended from time to time.

4. Payments

4.1 You agree to pay in full the camping and other fees and charges referred to in 3 at the time of booking your selected camp site to secure your booking (booking fees).

4.2 To secure information relating to your payment of the booking fees, all transactions are handled by the Commonwealth Bank “Virtual Payment Client” and no credit card details are captured or stored by us.

5. Alterations to Booking

Subject to the express terms and conditions of this agreement, any request made by you to alter any of your existing booking details will be considered by us and any decision to alter your booking details shall be at our absolute discretion. Any alterations may incur a $10.00 surcharge to cover administration costs at our absolute discretion.

5.1 Booking Additional Nights

5.1.1 You may book additional nights, subject to availability, as a separate booking. Consecutive bookings for the same person or persons are subject to the maximum duration at 7.2 below. Should this condition be breached you may be directed to vacate the site or sites and the additional booking(s) and fee(s) will be forfeited at our absolute discretion.

5.1.2 Requests to extend a booking for a period within 48 hours of the request being made may be considered by us, subject to the length of time that you have already occupied the site, and the availability of sufficient sites for other campers.

5.2 Additional person(s) to existing booking: Provided that the maximum occupancy is not exceeded, and subject to all other conditions, additional persons may share the booked site, and additional payment be made on arrival.

5.3 Reduction of nights/persons/sites – cancellation in part:

5.3.1 If you reduce the number of nights/persons/sites (cancel your booking in part) at any time prior to the date 28 days before the commencement of the period booked, the appropriate portion of the booking fee will be refunded to you. Any cancellations in part may incur a $10.00 surcharge to cover administration costs at our absolute discretion.

5.3.2 Subject to the personal circumstances applying to you and our absolute discretion to refund booking fees under 6.4, if you cancel your booking of a camp site at any time on or after the date 28 days before the commencement of the period booked, including during the period booked, the booking fees shall be forfeited to us. In addition, you agree the booking fees will not be applied by us to any alternative camping options for you.

 

6. Cancellations/Credits/Refunds

6.1 If you cancel your booking of a camp site at any time prior to the date 28 days before the commencement of the period booked, the booking feeswill be refunded to you. Any cancellations may incur a $10.00 surcharge to cover administration costs at our absolute discretion. Some campgrounds mayapply a credit to be used within 12 months and at the specific national park that the original booking was made.

6.2 Subject to the personal circumstances applying to you and our absolute discretion to refund booking fees under 6.4, if you cancel your booking of a camp site at any time on or after the date 28 days before the commencement of the period booked, including during the period booked, the booking fees will not be held in credit by and shall be forfeited to us. In addition, you agree the booking fees will not be applied by us to any alternative camping options for you.

6.3 If you do not arrive at the camp site the subject of your booking within 24 hours after 2pm on the commencement date of the period booked, we may at our absolute discretion treat your booking as having been cancelled and release the site to other campers. If you contact us before 2pm on the day after such commencement date, we will consider any request not to treat your booking as having been cancelled. If we decide to treat your booking as having been cancelled, the booking fees will not be held in credit by and shall be forfeited to us. In addition, you agree the booking fees will not be applied by us to any alternative camping options for you.

6.4 For the purposes of 6.2:

6.4.1 “personal circumstances” includes a death, serious illness or severe injury in your immediate family, either before the commencement of the period booked, or during the period booked;

6.4.2 where “personal circumstances” are claimed by you as the reason for the late cancellation of a booking, subject to you providing us with written evidence of such “personal circumstances” (which includes a Doctor’s certificate or statutory declaration by you) within 28 days of the end of the booking period, we will consider such circumstances and, any associated request for a refund;

6.4.3 any decision to refund all or any part of the booking fees shall be at our absolute discretion;

6.4.4 any claim by you for a refund of the booking fees must be received by us within 28 days of the end of the booking period, and may take 30 days to be processed.

6.5 We will not consider any claim for a refund/credit based on circumstances outside of our control, including;

6.5.1 unfavourable or unpleasant weather conditions before or during the booking period;

6.5.2 ill health, sickness or incapacity not supported by a medical certificate signed by a medical doctor verifying the incapacity claimed by you or any other persons planning to use the booking.

 

7. Bookings

7.1 Bookings can be accepted by us up to 10 months in advance of the booking date unless stated otherwise in the special conditions for a specific campground.

7.2 One or more bookings for the same person or persons must not exceed 28 consecutive days and/or 14 days during school holidays (whether or not all of those days occur during the school holidays) in Cape Range National Park.

7.3 As a party to this agreement you must occupy the camp site that you have booked during the booking period and will be responsible for all the actions of any other persons who accompany you If you fail to occupy the site during any night of the booking period, we may at our absolute discretion, treat your booking as having been cancelled and release the site to other campers. If we decide to treat your booking as having been cancelled, the proportion of the booking fees applicable to the remaining days of the booking period will not be held in credit by and shall be forfeited to us. In addition, you agree suchbooking fees will not be applied by us to any alternative camping options for you.

7.4 Bookings are not transferable to another party under any circumstances.

7.5 The minimum age for any person making a booking shall be 18 years.

7.6 Arrival time for bookings; The arrival time for bookings is after 2pm on the commencement day of the booking period unless stated otherwise in the special conditions for a specific campground. Booked sites must be vacated no later than 10am on the last day of the booking period unless alternativearrangements are made with the local DEC District office or the ranger in charge of the park.

 

8. Right of Closure

8.1 We retain the right to close camping areas without notice for management reasons or unforeseen circumstances such as, and not limited to, weather extremes or emergency reasons (for eg fires).

8.2 Where we have closed a camping area, persons affected by that closure will, where possible be offered alternative camping arrangements for any unused booking periods or for the unused balance of any booking period at no additional cost. Such alternative arrangements will apply to and must be used within 12 months from the first day of the booking period.

8.3 Where we have closed a camping area, if no alternative camping area is available or the alternative site offered is unacceptable to you, we will refund the booking fee or any unused balance of the booking fee to you.

 

9. Receipts

9.1 We will only recognise official receipts issued by us as proof of booking.

9.2 You agree to produce the official receipt regarding your booking of a camp site when requested by a Department of Environment and Conservation (DEC) officer or ranger.

9.3 If you or the occupants of a camp site have a vehicle, the booking receipt must be left in a visible location on the dashboard of the vehicle whenever it is in or near the camp site.

 

10. Generators

10.1 You agree to use and ensure all other occupants use the booked camp site in accordance with the conditions set down for generator use at that particular site.

11. Pets

11.1 Pets are not allowed in camping areas unless the area has been designated for that purpose by way of a notice declared by the Chief Executive Officer of DEC (CEO) pursuant to regulation 6 of the CALM Regulations, or with the written approval of the CEO or his delegate.

12. Legislation and Regulations

12.1 You and any persons using the camp site that you have booked, during the booking period, are required to comply with the CALM Act, CALM Regulations, the Wildlife Conservation Act 1950, the Wildlife Conservation Regulations 1974 and any other relevant law. Penalties apply for non-compliance with the same.

13. Breaches of any of the terms and conditions

13.1 Subject to the express terms and conditions of this agreement, in the event of any breach by you, or other occupants of the booked site, of the terms and conditions of this agreement, or of legislation or regulations referred to at 12.1, during the booking period, we may at our absolute discretion terminate this agreement by notice given to you, whether verbally or in writing.

 

13.2 On termination of this agreement, we shall treat the remainder of the booking period as cancelled and the proportion of the booking fees applicable to the remaining days of the booking period will not be held in credit by and shall be forfeited to us. In addition, you agree such booking fees will not be applied by us to any alternative camping options for you.

 

14. Camp Ground Specific Terms and Conditions

Some camp grounds have specific terms and conditions, which can be found in the relevant  camp ground description and information. Where applicable to your selected camp site, such specific terms and conditions shall form part of this agreement.

 

15. Access Outside of Australia

We do not represent that material or services on the System are appropriate or available for use in countries outside of Australia. If you choose to access the System from outside of Australia you are responsible for compliance with foreign and local laws.

 

16. Governing Law

This agreement is governed by the laws of the State of Western Australia.

 

17. Entire Agreement

This agreement constitutes the whole agreement between you and us and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.

 

18. Waiver

None of the terms and conditions in this agreement shall be waived except by written notice signed by the parties to this agreement.
