The Department of Environment and Conservation has strong regulatory powers to manage and protect the environment, particularly in areas where human activities have the potential to pollute or otherwise impact on the quality of air, land or water. Some of this is carried out through industry regulation including:

  • licensing and registration of prescribed premises
  • licensing of controlled waste transporters
  • administration of the Environmental Protection Regulations
  • ensuring emissions and discharges meet acceptable criteria
  • ensuring contaminated sites are appropriately managed
  • effectively responding to pollution incidents.

Our role - Industry Licensing and Regulation

The department has responsibility under Part V of the Environmental Protection Act 1986 for the licensing and registration of prescribed premises, licensing of controlled waste transporters, and administration of a range of regulations. We also monitor and audit compliance with works approvals, licence conditions and regulations, take enforcement actions as appropriate, and develop and implement departmental licensing and industry regulation policy.

Legislation

We fulfill our statutory licensing and regulatory role through a range of legislation. Primary licensing and regulation legislation including:

  • Part V of the Environmental Protection Act 1986
  • the Environmental Protection Regulations 1987.

Copies of the legislation can be obtained directly from the State Law Publisher's website.
