National Greenhouse and Energy Reporting Act 2007

The National Greenhouse and Energy Reporting Act 2007 (NGER Act) came into effect in September 2007. The Act makes it mandatory for constitutional corporations to report annually on greenhouse gas emissions, energy production and energy consumption if the thresholds defined in the Act. Implications for constitutional corporations

Legislation was being developed to require companies and trading enterprises that emitted over certain thresholds to report to a WAGGI. However given the passing of the NGER Act and consistent with its commitment to streamlining greenhouse reporting, the WA Government will not require constitutional corporations required to report under the NGER Act to report under a WA greenhouse reporting scheme.

Implications for WA public sector bodies

Some public sector bodies are constitutional corporations. Public sector bodies that are constitutional corporations and that do exceed the thresholds defined in the NGER Act have reporting obligations under the Act. The Office of Climate Change strongly recommends that public sector bodies seek legal advice to determine if they have obligations under the NGER Act.

Public sector bodies that are not constitutional corporations do not have any obligations under the NGER Act.

System for Accounting and Reporting of Government Emissions (SARGE)

The Office of Climate Change is continuing to develop a framework for government agency greenhouse gas emissions reporting. This framework will be based on the existing WAGGI reporting requirements but will be known as the System for Accounting and Reporting of Government Emissions (SARGE).

SARGE will apply only to WA government agencies that are not constitutional corporations and that emit equal to or more than 1,000tCO2-e from stationary energy sources in the 2007-2008 financial year.

Resources available

The Office of Climate Change has developed resources to assist agencies to prepare their SARGE reports.

The SARGE Reporting guidelines provide information to help government agencies to determine if they are required to report to the SARGE and if reporting is required, to prepare and submit a SARGE report.
Agencies should use the SARGE Reporting forms to prepare their reports.

Deadline for reporting

Agencies must report on a financial year basis, that is, the reporting year will commence on 1 July and conclude on 30 June of the following year. Annual reports must be submitted to the Office of Climate Change within six months after the conclusion of each financial year, i.e. by 31 December of each year.
